§ 1 Basic Provisions
(1) The following terms and conditions apply to all contracts that you conclude with us as a supplier (Ankush Nagaraju) via the website bhimamarkt.com. Unless otherwise agreed, the inclusion of any terms and conditions of your own that you may use is contradicted.
§ 2 Conclusion of the contract
(1) The subject of the contract is the sale of goods.
(2) As soon as the respective product is posted on our website, we submit a binding offer to conclude a contract via the online shopping cart system under the conditions stated in the item description.
(3) The contract is concluded via the online shopping cart system.
§ 3 Payment
(1) You have the following payment options:
- Payments are processed exclusively through Stripe. Available methods may include credit/debit cards, Klarna, SEPA Direct Debit, Apple Pay and Google Pay, depending on eligibility and the options displayed at checkout.
(2) Prices include statutory VAT (MwSt.).
§ 4 Retention of title
(1) You only have a right of retention if the claims relate to the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
§ 5 Warranty
(1) The statutory warranty rights apply.
(2) As a consumer, you are requested to check the item immediately upon delivery for completeness, obvious defects, and transport damage and to notify us of any complaints as quickly as possible. Failure to do so does not restrict your statutory rights.
§ 6 Choice of law, place of performance, place of jurisdiction
(1) German law applies. In the case of consumers, this choice of law applies only insofar as the protection granted by the mandatory provisions of the law of the state of the consumer’s usual residence is not thereby withdrawn (favourability principle).
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) explicitly do not apply.
